OHS Penalties & Enforcement

All accidents in the workplace causing serious injury or fatalities must be reported to the relevant authority
(e.g. WorkSafe), and may be investigated.

Penalties including financial fines and/or jail sentences will be issued to negligible people, employers or employees (See Fig 52).

The OHS Authorities, Inspectors, can also issue notices to employers to improve or fix something they consider to be harmful.

There are two types of notices:

  1. Improvement Notice – A company is given a reasonable time to fix something but can continue the practice/activity with satisfactory preventative measures in place;
  2. Prohibition notice – Company must stop the activity until the issue or problem has been fixed.                 

By law, these notices must be obeyed and have considerable fines for not enough action.

It is important to remember that safety is everyone’s responsibility, and if you are caught doing something which is unsafe you may be dismissed.
